Recognizing the serious nature of distracted driving in Tennessee

Distracted driving has received renewed attention in recent years because of the prevalence of handheld electronic devices being used by drivers. Text messaging has particularly resulted in serious concerns due to the fact that it includes visual, manual, and cognitive distractions in one activity. Any of these types of distraction alone can create a hazard for a driver and others on the roads of Tennessee. However, combined distractions can be disastrous.

From 2011 to 2012, the number of individuals who perished in distracted driving car accidents decreased slightly. However, the number of individuals injured in such events increased by 9 percent over the same period. Nearly 20 percent of injury accidents included distracted driving as a factor during 2011. As drivers have been surveyed about their activities while behind the wheel, nearly 70 percent admitted to distraction via cell phone use withing the month prior to the survey. Approximately one-third of drivers surveyed had been involved in email or text messaging activity behind the wheel.

Risk levels appear to be greater for such distractions with younger drivers. The under-20 age group has the highest level of fatal distracted driving auto accidents. Laws are being created in many states to address the issue, but there isn’t a clear awareness of whether legislation has improved the situation at this time. Although teen drivers are viewed as one of the groups with high risk levels, action is being taken to address concerns in public transportation and commercial driving as well.

Any hazardous driving behavior that takes a motorist’s attention away from the road can pose risks to others in the same vehicles or to those in other vehicles. An individual who is seriously injured because of negligent driving involving a distraction may find that personal injury action is appropriate for dealing with damages that exceed the benefits available through motor vehicle insurance.

Teen driver hits tree, 3 killed, 1 injured

Authorities with the Tennessee Highway Patrol reported that three teenagers were killed and one seriously injured when the car in which the four were riding lost control and hit a tree in Kodak. The accident occurred on Feb. 6 around 9:55 a.m. Two of the teenagers were reportedly skipping school at the time of the accident.

According to investigators, one teen was behind the wheel of the car. His younger sister was also in the car, as were two 18-year-old males. The driver of the car was reportedly speeding and lost control of the vehicle, leaving the roadway and striking an embankment. It subsequently crashed into the tree near Bent Road.

The driver, his sister and one of the 18-year-old men were killed. The other 18-year-old man was sitting in the backseat at the time of the accident. Officers indicated he was thrown from the vehicle but survived. He reportedly crawled towards the roadway in an effort to get help. Emergency responders flew the young man via LifeStar to University of Tennessee Medical Center. Reportedly, he is now talking and awake. There is no indication that drugs or alcohol were involved in the accident.

When people are killed or seriously injured in a car accident caused by the negligent driving of another, the families of those who are killed and the people who are seriously injured may be able to recover damages by filing wrongful death or personal injury civil lawsuits against the driver. When the driver is also killed, people may still recover damages by naming the estate of the negligent driver as the defendant to the lawsuit. In some cases in which a minor is the driver, the parents may also be held to be vicariously liable.

Drunk Driving Accidents

Drunk driving responsible for nearly one-third of traffic deaths

Each day, millions of Tennessee drivers take to the road. Whether on an interstate or a dusty East Tennessee back road, automobile travelers face the risk of encountering impaired drivers. Despite being preventable, accidents caused by drunk driving can lead to permanent injury or death.

According to the Centers for Disease Control and Prevention, alcohol-impaired driving accidents resulted in 31 percent of traffic-related deaths in 2012. In 18 percent of traffic-related deaths, substances other than alcohol were involved. Unfortunately, many of these deaths involved children. For all children involved in traffic-related deaths in 2012, 1 in 5 were killed by impaired drivers.

However, unlike other driving accidents, those caused by alcohol or substance use are preventable. Laws criminalizing intoxicated driving do reduce the number of alcohol- and drug-related driving deaths. However, the number of drivers who self-report driving under the influence is significantly higher than the number of individuals arrested each year. Reducing the number of impaired drivers on the road requires more than adequate policing. Individuals’ choices significantly impact the number of impaired drivers on the road.

When drinking, friends can take steps to make sure everyone has fun but also stays safe. Having a designated driver ensures that no one takes the wheel in an impaired condition. Individuals can also keep the number of a cab company handy.

Unfortunately, not all drivers will take these precautions, resulting in unnecessary suffering for many. Accident injuries from drunk driving can result in high medical bills, lost income and death. Personal injury lawyers can help individuals who have suffered at the hands of an impaired driver. Their knowledge of the law can help victims fight back and recover losses resulting from the accident.

Accident danger point: half-worn tires

Tennessee drivers may be driving confidently with half the tread left on their tires. However, tires give up significant ability to grip road surfaces even with half the tread left, especially during rain and snow. Hydroplaning, when tires lose their grip on the road and driver cannot control the steering, can become a serious problem on wet roads that may lead to car accidents. While even new tires can hydroplane and lose their grip, at half the tread tires hydroplane more quickly and at lower speeds.

To make sure tires have enough tread, measure with an inexpensive tread-depth gauge by using a penny to measure the depth of each tire groove. If the top of Abe’s head is showing in any of the grooves, the tires have reached their wear limit and need to be replaced. When tires are new, they have 10/32 inch-deep groves. When the grooves measure 2/32 inch deep, they are considered bald.

Consumer Reports tested tires by comparing full- and half-tread performance in wet, snowy and dry conditions. In wet conditions, half-tread tires had about 8 percent less hydroplaning resistance. On snow, half-tread tires showed a loss of 15 percent snow traction. Only on dry pavement did half-tread tires grip better, so they could be safer in arid conditions, but not when there is rain or snow.

Because tires with less tread take longer to stop, can hydroplane and have less traction, they can contribute to automobile accidents. A lawyer may be able to help a person who has a personal injury in an auto accident, such as trauma, broken bones or brain injury. If a negligent driver who may have failed to maintain his vehicle properly allegedly caused the crash, a lawyer could help the injured party file an insurance claim seeking compensation for the injuries.

Large truck accidents in Tennessee

According to the National Highway Traffic Safety Administration, there were more than 1,370 vehicles involved in fatal crashes in Tennessee during 2012. More than 100 of the vehicles involved in these incidents were large trucks, accounting for under 8 percent of the total. The number of large trucks in fatal accidents within Tennessee only accounted for less than 3 percent of the country’s total. Nationwide, there were more than 45,600 fatal motor vehicle accidents reported during 2012.

Large trucks accounted for more than 8 percent of the nation’s fatal accidents in that year. Almost 4,000 people were killed and over 100,000 suffered injuries in an accident involving a large truck. The NHTSA notes that there were more than 330,000 large trucks involved in traffic accidents during 2012. More than 80 percent of the fatal accidents involving large trucks were multi-vehicle crashes.

Multi-vehicle crashes accounted for less than 60 percent of the fatal accidents only involving passenger vehicles. Researchers also found that large trucks were over three times as likely to be involved in a fatal rear-end collision than passenger vehicles. More than 30 percent of the fatal crashes involving a large truck and one other vehicle resulted in damage being inflicted on both front-ends. In over 45 percent of the fatal accidents, a large truck and another vehicle were heading in a straight direction when the incident occurred.

Anyone who has suffered an injury in a large truck accident might benefit from consulting a lawyer. Legal counsel may be able to investigate the crash and determine who may be held accountable for the ensuing damages. Plaintiffs in these cases are often entitled to receive restitution that can help compensate for medical costs, repair expenses, loss of income and other hardships caused by the accident.

Motorcycle accidents in Tennessee

Many people enjoy riding on motorcycles as they feel a sense of freedom from the activity. Unfortunately, however, motorcyclists are at an increased risk of serious injury or death in the event they are involved in a collision. Motorcyclists simply have less protection in an accident than do people who are riding in other types of motor vehicles.

When a motorcycle crash occurs, cyclists have a 26 times greater likelihood of dying than people in cars. They are also five times likelier to be seriously injured. In two-thirds of motorcycle-vehicle collisions, the other motorist is at fault and violated the motorcyclist’s right-of-way.

Several factors can lead to the increased risk to cyclists. As they are simply smaller than other vehicles, they are likewise more difficult to see. Many motorists are involved in collisions with motorcyclists when the motorist turns left across a highway, failing to notice an oncoming motorcycle when doing so. Around 70 percent of these collisions occur at intersections. Motorcycles also have wobble in their front tires at higher speeds, making it more likely the cyclist will lose control. Road hazards, such as potholes and others that are easy for vehicles to deal with are difficult for cyclists, and some cyclists are simply inexperienced and unable to drive defensively.

Motorcycle accident are often catastrophic, resulting either in death or lifelong disability. People who are seriously injured by negligent motorists in a motorcycle crash are often left with a stack of bills and expenses while also being left unable to work. Victims may recover damages by holding the motorist civilly liable for his or her negligence. Through filing a personal injury civil lawsuit against the driver, victims may recover compensation for the losses they have sustained, and a personal injury attorney may be able to help.

Factors that may determine liability in traffic accidents

Drivers from Tennessee may be interested in learning what factors make a driver liable for a car accident. Whenever illegal activity, such as driving while intoxicated or traveling above the speed limit, causes a car accident, the driver who was not complying with the law might be held liable for damages stemming from the crash.

Negligence typically occurs when a driver is being careless while behind the wheel and causes injury or damage to another motorist. Recklessness typically refers to disregarding the safety or well-being of others. Whenever damage or injury is caused by an absence of fault, such as a car having defective auto parts or a commercial vehicle operator transporting hazardous chemicals, strict liability may be established. Motor vehicle statutes are what determine who will be responsible to pay for those damages.

In an effort to make it easier to be able to challenge fault when one of their customers is involved in an accident in which they broke a traffic law, the auto insurance industry requested that legislatures base the liability on motor vehicle statutes rather than common legal assumptions. There are four basic levels of common law faults, including negligence, recklessness, intentional misconduct and strict liability.

Understanding if a common law fault occurred depends on the state’s roadway mandates and the specific circumstances that lead to the traffic accident. There are a number of common traffic incidents that take place every day in the United States, and these range in severity and repercussions. Many of these incidents are caused by negligent behavior, such as distracted driving, failure to yield, driving under the influence, driving while texting and more. Whenever an individual is involved in an automobile accident and feels that another motorist may be at fault, a lawyer who is familiar with traffic cases might be able to help assist in building a case.

Examining priorities in trucking safety

Tennessee motorists may have heard that the U.S. National Transportation Safety Board is concerned with the failure of regulators to act on many matters related to trucking safety in recent years. The board has stated its belief that changes are necessary in the coming year. In a recent news conference, the NTSB referenced the injury of comedian Tracy Morgan as it highlighted statistics that reflect a need for aggressive action.

Technology is highlighted as one of the areas for promoting a reduction in truck crashes. Sensors that could warn drivers of potential lane changes or collision risks could minimize the potential for accidents. Additional points of emphasis should include improved oversight of hour limits for drivers as well as more effective regulation of trucking entities that have reported high rates of accidents.

Statistically, the board notes a four-year trend of increasing numbers of fatalities connected with trucking accidents. From 2009 to 2013, the incidentshave increased by 17 percent. Fatigue was a concern in the Tracy Morgan situation, and the NTSB recommends more thorough screening for sleep disorders and other related conditions that could jeopardize motorists. Safety enforcement is also cited as a potential area that may be tied to problems with trucking accidents. Meanwhile, some regulations may have been weakened because of congressional efforts to promote further research of the effects of rush-hour driving on trucking incidents.

Although national efforts to tighten regulations may be important, those future actions do little to help a motorist who is currently suffering damages and injuries because of an accident involving a fatigued or otherwise negligent truck driver. A successful personal injury claim could assist in covering past, current and future medical expenses as well as providing compensation for other damages incurred.

Tennessee man seriously injured in wrong-way accident

A part-time musician faces extensive rehabilitation after being seriously hurt in a deadly collision in Tennessee on Jan. 10. At press time, the man was undergoing treatment for his injuries at Skyline Medical Center in the neurological intensive care unit. News sources say that the injured man was traveling in a fellow musician’s Corvette when it was hit by a wrong-way driver on Interstate 65. The driver of the Corvette lost his life in the crash.

The incident happened near Old Hickory Boulevard at the Bridgestone Arena in Nashville. Reports indicate that the 38-year-old woman who allegedly caused the fatal car accident is expected to be charged with vehicular assault and vehicular homicide by intoxication upon her release from the hospital where she is also undergoing treatment for serious injuries.

Few details about the accident are available. According to news sources, authorities received a number of emergency calls from drivers who spotted the wrong-way driver prior to the incident. However, police were not able to stop the alleged drunk driver in time to prevent the collision.

When a person is catastrophically injured in an accident, mounting medical bills and lost wages may represent only a fraction of the total loss that the individual might suffer. Knoxville residents facing such circumstances may find it beneficial to ask a personal injury attorney for help. An attorney may be able to determine the true value of a claim as well as negotiate a favorable settlement for clients outside of the courtroom. The attorney could also establish liability of all negligent parties in a claim.
